How You Use Our Service

1. Introduction

Welcome to Smoling. By accessing or using Smoling ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Accounts & Eligibility

To use Smoling, you must be at least 13 years of age. By creating an account, you represent that you meet this requirement.

You are responsible for maintaining the security of your account and password. You agree to notify us immediately at [email protected] upon becoming aware of any unauthorised access or breach of your account.

3. Acceptable Use

Smoling is a tool for shortening links and sharing files. You are solely responsible for all content you upload, share, or distribute through the Service.

Prohibited Content and Uses

You agree not to use Smoling to:

  • Upload, share, or distribute illegal content of any kind
  • Distribute malware, viruses, or any malicious code
  • Share content that infringes on intellectual property rights
  • Conduct phishing, spam, or fraudulent activities
  • Harass, threaten, or harm others
  • Circumvent or abuse platform limits or promotional offers
  • Use the Service in any way that violates applicable laws

    • We reserve the right to remove any content and suspend or terminate accounts that violate these terms, without prior notice or liability.

    4. Subscriptions & Payments

    Smoling offers a free tier and paid subscription plans (Pro and Growth). Paid plans are billed monthly or annually through our payment partner, Polar.

    Refunds

    We offer a full refund within 14 days of your first payment if you are not satisfied with the Service. After the initial 14 day period, payments are non-refundable. To request a refund, email us at [email protected] with your account details

    Cancellation

    You may cancel your subscription at any time from the Billing page. Upon cancellation, you retain access to your paid plan until the end of the current billing period. After that, your account reverts to the free tier — your links, file and data remain intact.

    Plans

    Each plan includes a monthly quota of links and files. Unused quota does not roll over to the next month. If you reach your monthly quota, you will not be able to create new links or upload new files until the quota resets or you upgrade your plan.

    4. File Storage

    Files you upload to Smoling are stored on Cloudflare R2 and are private by default. They are only accessible via your Smoling short link.

    When you delete a file link, the file is permanently removed from storage immediately. We are not responsible for any loss of files resulting from deletion, account closure, or service disruption.

    4. Account Suspension & Termination

    We reserve the right to suspend or terminate your account:

  • Without notice for serious violations including illegal content, malware distribution, phishing, or fraud
  • With reasonable notice for repeated or escalating policy violations
  • For non-payment or chargebacks that result in an outstanding balance

    • Upon termination, your links will stop functioning and your files will be permanently deleted from storage.

    You may delete your account at any time from Settings → Account → Danger Zone. All your data will be permanently erased upon deletion.

    4. Third-Party Services

    Smoling uses third-party services including Cloudflare, Polar, PostHog and Better Auth to operate the Service. By using Smoling, you acknowledge that your interactions with these services are also governed by their respective terms and privacy policies.

    6. Intellectual Property

    Smoling and its original content, features and functionality are the exclusive property of Smoling. Any content you create or upload remains yours. By using the Service, you grant us a limited licence to store and serve your content solely for the purpose of providing the Service.

    7. Limitation of Liability

    To the maximum extent permitted by law, Smoling shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of or inability to use the Service.

    8. Changes to These Terms

    We reserve the right to modify these Terms at any time. Changes take effect immediately upon being posted on this page. Continued use of the Service after changes constitutes acceptance of the updated terms. We will make reasonable efforts to notify users of significant changes.

    9. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
